In making the Privacy Notice (the “Notice”) known and publicly available, BigUp seeks to make clear its practices concerning its use of any data that you (individually, a “User” and collectively, “Users”), may disclose, from time to time, with BigUp in return for the enjoyment of BigUp’s services (“BigUp Services”). By setting up your BigUp account, and generally in using BigUp Services, you affirm that you accept this Privacy Notice, subject to any limitations provided by law applicable in your location.
BigUp is classified by data privacy laws, where applicable, as a “data controller” of the information you provide in using BigUp Services. Personal Information BigUp Collects
BigUp obtains User data in the following three ways: (1) Required Data mandatorily collected by BigUp to enable Users to access BigUp services; (2) Optional Data, which Users may at their discretion and choice provide BigUp in the course of using BigUp services; and (3) Automatically Collected Data, which is collected by the use of cookies and third-party services used by BigUp, enabling BigUp to provide a variety of services to Users. Please note that, across these categories, BigUp requires certain types of information so that it can provide the BigUp Services to you. If you do not provide BigUp with certain types of information, as mentioned below, or request that BigUp delete such data, you may no longer be able to access or use the BigUp Services.
1. Required Data
BigUp requires Users to provide certain types of information before you can access BigUp Services. This includes your email address, name, username, password, and select personal details, such as, but not limited to, personal preferences, club affiliation, gender and related preferences, and date of birth. Some of this information is classed by data privacy and protection laws, where applicable, as “personal data.” BigUp uses such data to ensure safety for Users; to verify identities of Users; to communicate with Users about upcoming events, developments in BigUp Services, changes in policies concerning use of BigUp Services; to ensure compliance with applicable laws and regulations; to ensure and track performance of BigUp Services, technical or otherwise. Under the GDPR, which is European Economic Area (EEA)-applicable law, and in certain other jurisdictions, data privacy or protection laws permit you to request the modification or deletion of your personal data. You may do so using the process defined later in this Notice. Please note, however, that requesting deletion of the category of data listed above in this paragraph would result in BigUp being unable to continue providing BigUp Services to you.
2. Optional Data
From time to time, or for the provision of certain exclusive services, or for providing Users the ability to customize their use of BigUp Services, BigUp may request Users to provide additional types of information, including, for instance, profile pictures, avatars, or other markers of digital identity; credit card of payment information; location; preferences pertaining to sports teams or other related allegiances. BigUp may also invite, or provide space for, Users to share optional other details that may, in connection with other information that Users share, be considered personal data under applicable data privacy or protection laws. BigUp also provides Users the ability to freely contribute to online discussions through a live webchat option that accompanies BigUp livestream events. In contributing such information, Users understand that BigUp may record and store such information for the purposes of quality control, archiving BigUp Services for later viewing or public use, compliance and legal purposes, and for other performance-related processing. Users may, in certain cases and in compliance with data privacy and protection laws that vary by jurisdiction, request the deletion of such optional data as stored by BigUp, but are made aware that BigUp may not be able in each instance to effectively scrub such optional data, and that BigUp may assert defenses in response to requests for deletion in compliance and with and as permitted by applicable laws and regulations.Users should note that, due to the social nature of participation in certain optional activities on BigUp, such as by messaging using the chat function, Users’ information, voluntarily and willingly provided, may be visible to other participants in that chat or to those generally participating in an associated social experience.
Users should at all times remain mindful of the visibility of the information they share on BigUp, and should further note that BigUp reserves to itself the right to moderate user interactions with the BigUp platform, including restricting the use of certain categories of contributions to ensure the safety of its Users and to comply with applicable regulations, as outlined below.
3. Automatically-Collected DataBigUp, in the ordinary course of providing services to users, to improve user experience and platform performance, and for other purposes such as ensuring legal compliance and for marketing or advertising purposes, may track, amongst other categories and without limitation, the following activity: website usage, pages or any BigUp services accessed while using www.bigup.com, and geographical location. For such purpose, BigUp may engage third party services as aggregators or for performance enhancement. Under certain jurisdictions, users may withhold consent for the collection or processing of automatically-collected data. Users may make such requests in the manner specified above in this Notice. Please note, however, that BigUp may assert legally permissible defenses to such request(s). It may not, for instance, be commercially reasonable or practically possible for BigUp to exclude specific users from specific categories of automatic data collection. In such instances, should a user choose to withhold consent, BigUp may be unable to provide any services to such user.
Administration of Data
BigUp retains the power and authority, in the interest of ensuring a safe and legally compliant virtual environment for its users, to moderate user contributions, whether expressed through choice of username or provided through the chat function or by any other means of expression while using the BigUp platform. BigUp retains the discretion and exclusive right to apply and administer reasonable restrictions, including suspending users or restricting users’ access to BigUp services temporarily or permanently.
BigUp may retain the Data collected until User deletes their user profile on the BigUp platform, or provides notice to BigUp under the terms of this Notice, subject to applicable laws permitting BigUp to retain user data. BigUp may retain, on an anonymized or particularized basis, automatically-collected Data should it determine, at its discretion, that retention or further processing of such data would improve the provision of BigUp Services to users.
Requesting or Modifying Information
Users from specific legal jurisdictions may request further information from BigUp regarding the categories and types of Data that BigUp has collected about their particular usage of the BigUp platform. Before making such a request, Users are advised to consult the particulars of this Notice, specifically those sections that outline the types and means of data collection. Under the GDPR, which is EEA-applicable law, Users retain the right to seek assistance from the applicable supervisory authority concerning the use or collection of their Data on commercial platforms, including on BigUp. Users from select jurisdictions may also request that any personal information collected is duly rectified or corrected, and may make such requests by emailing privacy@bigup.com.
Where user Data is being utilized for direct marketing purposes, such as BigUp communicating particular services or events to Users, Users in applicable jurisdictions, such as the EEA, retain the right to opt out of such communications or otherwise request that BigUp not collect or utilize data for such purpose.
Account Deletion
Should you wish to delete your account, you may email such request to privacy@bigup.com. Please note that BigUp may retain certain information about Users as permitted by applicable law, and only for such purposes as are outlined in this Notice.
Privacy of Children and Underage Persons
BigUp does not knowingly collect, maintain or otherwise use personal information from persons under the age of 16. Users under the age of 13 years may not use or access BigUp Services, and those users between the ages of 13 and 16 years shall only access BigUp Services after obtaining parental permission. BigUp reserves the right to unilaterally delete or otherwise take appropriate steps to safeguard the rights of Users should it learn of unauthorized access of BigUp Services by underage persons or in the event that BigUp learns that such information has been communicated to BigUp by any means. For parents or guardians of an underage person who has created a BigUp account, please email privacy@bigup.com to request deletion of the relevant user account.
Merger or Sale
In the event that BigUp, or some or all assets related to BigUp Services are acquired by, sold to, or merged with any third-party entity, or if BigUp otherwise changes ownership, it reserves the right to transfer or assign the information that we have collected from users as part of that merger, acquisition, sale, or other change-of-ownership event, and may disclose such information in the course of diligence contemplating such an event.
Changes to Privacy NoticeBigUp reserves the right to change, amend, correct, modify, add or remove portions of this Notice at any time and for any reason, such as to reflect changes in BigUp Services or to comply with legal rules and regulations. Users are advised to periodically review the Notice for any updates. For substantial or material changes to the Notice, which would adversely affect protections for User privacy, BigUp will promptly alert and notify Users using the means of communication available to BigUp and in compliance with applicable law.
